Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SortAIfy platform and services ("Service") operated by SortAIfy GmbH ("SortAIfy", "we", "our", or "us"). By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

SortAIfy provides an AI-powered document classification and cloud storage organization platform. The Service allows users to:

• Upload documents for AI-powered classification (using Google Gemini AI).
• Connect cloud storage providers (Google Drive, Dropbox, OneDrive, AWS S3).
• Automatically route classified documents to connected storage.
• Access classification history and analytics.

Documents are processed in volatile memory and are not permanently stored on SortAIfy's servers.

3. Account Registration and Eligibility

To use the Service, you must create an account. You must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

The Service is available to users aged 16 and older. By registering, you represent that you meet this age requirement.

4. Subscription Plans and Payments

4.1 Free and Paid Plans

SortAIfy offers Free and Pro subscription plans. Features and limitations are described on our Pricing page. We reserve the right to modify plan features and pricing with 30 days' notice.

4.2 Billing

Paid plans are billed monthly or annually in advance. Payment is processed by Stripe. All fees are exclusive of applicable taxes unless stated otherwise.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods, except as required by applicable law.

4.4 Credits

Pro plan subscribers receive monthly document processing credits. Unused credits do not roll over to the next month. Credit usage is described on the Pricing page.

5. Acceptable Use

You agree NOT to use the Service to:

• Upload or process documents that are unlawful, harmful, threatening, defamatory, or infringing.
• Upload documents containing personal data of third parties without lawful basis.
• Attempt to gain unauthorized access to any part of the Service.
• Reverse engineer, decompile, or disassemble the Service.
• Use automated tools (bots, scrapers) without prior written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Circumvent any usage limits or security measures.

6. User Content and Data

You retain ownership of all documents you upload ("User Content"). By uploading documents, you grant SortAIfy a limited license to process them for classification purposes only.

User Content is processed in ephemeral environments and is not permanently stored. Classification metadata is retained in your account as described in the Privacy Policy.

You represent that you own or have the necessary rights to upload and process all User Content, and that processing does not violate any third-party rights.

7. Third-Party Services and Providers

The Service integrates with third-party cloud storage providers and AI services:

• Cloud Storage: Google Drive, Dropbox, OneDrive, AWS S3 — governed by their respective terms and privacy policies.
• AI Processing: Google Gemini — governed by Google's privacy policy and terms.
• Payments: Stripe — governed by Stripe's terms of service.
• Authentication: Google OAuth — governed by Google's terms.

SortAIfy is not responsible for the practices of third-party services. Review their policies before connecting your accounts.

8. Intellectual Property

SortAIfy and its licensors own all rights, title, and interest in the Service, including the platform, software, algorithms, trademarks, and any content generated by the Service (excluding your User Content). These Terms do not grant you any ownership rights.

SortAIfy trademarks may not be used without prior written permission.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for service interruptions.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or uninterrupted, or that classification results will be 100% accurate. You acknowledge that AI classification may produce imperfect results.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SortAIfy SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

This limitation applies regardless of the form of action (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless SortAIfy and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

You may terminate your account at any time through the Service settings or by contacting support. We may suspend or terminate your access if you violate these Terms or if required to do so by law.

Upon termination, your right to use the Service ceases immediately. Data retention after termination is described in the Privacy Policy.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or notice in the Service. Continued use after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
